HARBOR RULES AND REGULATIONS

The Illinois Valley Yacht and Canoe Club assumes no liability for the boats of its members. Members must provide proof of adequate and current liability insurance to the Harbor Master prior to occupying a slip. Generally, a Certificate of Insurance from the membersÕ insurance agent on file in the Club office will satisfy this requirement.

 

SLIP ASSIGNMENTS

1.     No slip may be occupied unless a signed, correct and current Slip and Storage Agreement is on file with the Harbor Master.

2.     The Harbor Master will assign slips in accordance with these rules and regulations. Slips are assigned only to resident members in good standing, and are for their personal use and the use of their guests only. The slip may not be loaned, subleased, exchanged, or transferred in any manner by the member. Slips assigned to a member are for use only by boats owned by the member, which are under the memberÕs custody and control.

a.      A boat is considered to be owned by a member when it is titled in the memberÕs sole name or with such memberÕs spouse.

b.     Decisions of the Harbor Committee with respect to attribution of ownership or questions involving the effective custody, control, and principal user of boats shall be final, subject only to the appeal process described in these rules.

c.      In the case of a boat being owned by two or more members, the slip shall be assigned to only one owner.

d.     There shall be only one boat assigned per slip. No personal watercraft, dinghies, etc. are allowed in the slip with the registered boat.

3.     Slips shall be assigned and changed based on these major considerations:

a.      Members desiring a slip must request same in writing on a slip request form maintained by the Harbor Master.

b.      The date of the membersÕ slip application in chronological order.

c.     The size of the boat for proper harbor utilization, considering length and beam.

1.     Overhang and visibility will be the primary safety issues considered.

2.     Maneuverability and underulitization will be the secondary issues considered (Underutilization is defined as boats more than five feet L.O.A. shorter than the assigned slip).

d.     Once a member refuses a requested slip three times, that entire slip request will be considered cancelled. Refusal to accept a temporary slip assignment shall not count as a refusal.

e.     Members may have more than one slip request on file.

f.      The current slip application list is available upon request from the Harbor Master.

4.   Slip dimensions are taken from the Harbor Chart. A boat must fit within the confines of the slip and allow for at least one foot of clearance on each side. The Harbor Master must approve all overhangs. If a boat's nomenclature length is longer than the assigned slip length, an additional slip charge will be levied for each foot the nomenclature length is greater than the slip length. The extra charge per foot will be one-half the slip's charge per square foot.

5.   The boating season is defined as beginning April 1 and ending October 31 of the same year. Once a qualified member is assigned a summer slip, such member retains that assignment for consecutive seasons subject to the following provisions:

a.      The member must comply with all Harbor Rules. Failure to do so may be considered a surrender of the slip assignment by the Harbor Master.

b.     The member may choose to pay for their slip and leave it vacant or mostly vacant (50% of the season or more) for one boating season and still retain that slip for the next boating season. It is the member's responsibility to inform the Harbor Master in a timely manner of this situation. Under this provision, the member must occupy the slip the following boating season for at least 50% of that season. Exceptions and/or extensions must be requested in writing to the Harbor Master and approved by the Board. Failure to comply with these rules could result in forfeiture of the slip. Any money collected from the subsequent rental of such a vacant slip shall stay with the Club.

c.      Upon the death of any member assigned a slip, the surviving spouse of such member will maintain the right to that slip providing that such survivor is or becomes a resident member of the Club.

d.     Assignment of second slips will be made by January 31after all resident members have had the opportunity to rent one slip. One of the slips will be surrendered at the end of the current boating season.

e.      Boats sold to non-members must be removed from the harbor within one week of sale. Boats sold to Club members must be removed from the sellerÕs slip within one week of sale unless arrangements are approved by the Harbor Master.

f.      No slip may be used for commercial purposes including, but not limited to, the business of selling, demonstrating, renting or the conduct of any boating or sailing school.

g.     If no slip is available, floater assignments will be made. A floater is defined as a temporary mooring for a member and can be considered any available space in the Harbor, and will be charged the appropriate rate. The Harbor Committee reserves the right to limit the number of boats accepted as floaters. The following provisions apply to floaters:

1.     Floater size limits may be established by the Harbor Master.

2.     Boats will be placed in vacant slips anywhere in the Harbor as directed by the Harbor Master.

3.     Boats must be moved when the slips are to be used by the permanent assignee.

4.     Floaters may not use the mooring lines, dock boxes, or other equipment at the slips in which they are docked.

5.     If assigned a permanent slip, the floater will be charged on a pro-rata basis until the end of the season as determined by the Harbor Master.

h.     Intention to leave a slip vacant on Fridays, Saturdays, Sundays, holidays or extended periods of three days or more must be communicated to the Harbor Master for potential use by non-resident members and transients.

i.      Non-resident member boats remaining in the Harbor for a period over 4 hours and up to 24 hours shall be considered to have spent one day in the Harbor.

j.    All non-resident members are allowed nine night's per season of dockage at the Club, if available, at no charge. Extra nights are charged at the transient rate. The cumulative period of stay by non-resident boats, may be extended or special docking arrangements, not provided for by the Harbor Rules, may be granted when authorized by the Harbor Master. Any such extension or special arrangements may be reviewed or reversed at any time by either the chairman of the Harbor Committee or the Board of Directors.

k.     The following payment and refund schedule shall apply to all slips assigned or surrendered during the season. Refunds will not be granted once a slip is occupied.

      If the first payment is not received by January 31, the Harbor Master reserves the right to reassign that slip.

l.      It will be the Harbor MasterÕs responsibility to maintain a map of the harbor that will include such information as:

1.     Name of boat and member assigned.

2.     Size of slip.

3.     Current rate per year of slip.

4.     Current list of slip requests pending, including requests for specific slips.

      A member may appeal a decision by first contacting the Harbor Committee, second the Club Manager, and the third step would be to appeal, in writing, to the Board of Directors. The BoardÕs decision is final.

 

CONDUCT OF BOATS IN HARBOR

1.   Boat owners are responsible for all maintenance including, but not limited to, the covering and bailing of boats. In the event of a sinking, the owner is responsible for raising the vessel within one week. After one week, the Club may at its own discretion, raise the vessel and remediate any damage caused by the sinking, at the ownerÕs expense.

2.   Sailboats shall be operated in the North Harbor only under engine power.

3.   No-wake speeds are required in all harbors by all boats slow enough to stop in boatsÕ own boat length.

4.   Dinghies and Personal Watercraft shall not be operated in either Harbor, except to obtain gas or enter or leave. While in the harbor they must be operated at idle speed only. If the Personal Watercraft Owner does not rent a P.W.C. lift from the Club, they must obtain docking permission from the Harbor Master.

5.   All non-assigned tie-ups must be approved by the Harbor Master.

6.   Periodically, the Harbor Master will inspect the harbor for unsafe conditions or potentially dangerous practices. It is the boat ownersÕ responsibility to correct or secure the unsafe condition in an expeditious manner. If there are repeated offenders of unsafe practices, the Harbor Committee will report to the Board of Directors for appropriate action.

7.   During floods, storms, or for the proper management of the harbor, owners are responsible for the securing and safety of their boats and the movement of the boat as directed by the Harbor Master, Harbor Committee or an officer. If the owner does not comply with these instructions in a prompt manner, then the Club may move the boat without liability to the Club. The boat owner will be responsible for the cost of labor, materials and damage incurred.

8.     Slips must be maintained in a neat, orderly and safe condition. Dock lines, telephone lines, water, hoses, electric lines, or other obstructions may not be run across, on, or above the surface of the docks or walkways, except during daylight for maintenance/repair work in progress only. Each slip renter is responsible for their dock area.

9.     Boats leaving the Harbor have the right of way over boats entering the Harbor.

10.   Proper flag and signal etiquette are encouraged.

11.   Members are responsible for the conduct of their guests and crew members. All individuals on Club premises shall behave in a manner consistent with the high standards of the Club.

12.   Sailing or maneuvering in the Harbor in such a way as to create a hazard to navigation is prohibited. Boat owners and/or operators will be held jointly responsible for any damage to Club property and/or other boats.

13.   Engines may not be run for extended periods when docked.

14.   Water hoses and electric lines must be turned off when not in use and properly stowed off the dock surface with ends out of the water.

15.   Sailboats must secure their halyards so that they will not create a disturbance.

16.   All member boats must comply with all Federal, State and Local laws, rules, and regulations pertaining to the ownership, operations, or use of such boats. Such compliance to include, but not be limited to: equipment, operation, safety, discharge of oil, discharge of waste, and noise levels.

17.   No part of the boat may extend over the dock walkway. The Harbor Master reserves the right to move and retie any boat tied in a way unacceptable for safety purposes.

18.   Fuel trucks or unapproved portable fuel containers for the purpose of fueling boats are prohibited.

19.   The gas dock is to be used for re-fueling and head pump-out only.

20.   No fires, grills or other heat sources are permitted on the docks, fingers, or walkways. There are designated areas for cooking fires within the club grounds. Members may cook on their boats in the Harbor but not with charcoal.

21.   Dock lines must be of the appropriate size and condition for the vessel being moored. It is the ownerÕs responsibility to properly tend and secure their boat.

22.   Unsafe or substandard wiring or fixtures, or those ÒleakingÓ current into the water, or those immersed in the water, or those without ÒthirdÓ wire grounding will be removed when found. Any results of this removal are the ownerÕs responsibility. This is vital to your personal safety and should prevent electrolysis on neighboring boats.

23.   The period between 11:00 P.M. to 7:00 A.M. are designated quiet hours in the Harbor during the week. On weekends this period is 12:00 A.M. to 7:00 A.M. Members are asked to use consideration for others when entertaining at all other times and to keep noise at a minimum.

24.   Permission must be granted by the boat owner before boarding their boat, except in cases of emergencies when the ownerÕs interests are being protected.

25.   All vessels kept in the Harbor must meet U.S.C.G. seaworthy requirements. The Club reserves the right to remove any vessel deemed unseaworthy or hazardous to other boats, members, or Club premises at the ownerÕs expense.

26.   Violation of Harbor Rules may result in the member losing his slip. It is the Harbor MasterÕs responsibility to enforce these rules. Serious single infractions as well as accumulative minor infractions may result in the loss of the memberÕs slip. The Harbor Committee will take the violations to the Board of Directors for action. If the action of slip loss is contemplated, the member shall be invited to the appropriate Board meeting for their appeal. The action of the Board of Directors is final.

 

MAINTENANCE AND REPAIR

1.     Use of open flame tools is prohibited within the confines of the Harbor, except by Club personnel.

2.     Members are responsible for the conduct of their crews or contract labor that they hire to work on their boats and are liable for any damage caused by such labor. Contract labor or crews are not permitted to use Club facilities except the rest rooms. All contractor labor hired by a Club member must have a Certificate of Insurance on file with the Harbor Master.

3.     All docks and walkways must be kept clear of equipment to the extent practical in order to prevent accidents.

4.     Refuse must be deposited in the appropriate containers. Oil or oily bilge water may not be pumped into the Harbor. Dumping or emptying gasoline, refuse, or heads in the Harbor/river is prohibited. Portable toilet dumping facilities are available in the front circle of the Club into the sewer lines.

 

WINTER STORAGE

1.   All boats are required to be out of the Harbor by November lst of each year. Slips not vacated by this date may be charged a daily fee based on transient rates and moved at the ownerÕs expense.

2.   The Club has the sole discretion in accepting any vessel for extended periods beyond the November 1st date.

3.   There will be no winter slip assignments.

 

GENERAL

1.      Trailers not used for daily boat storage must be removed from the beach and parking lot to trailer storage.

2.      A summer and winter trailer storage fee will be charged. Every trailer must display the IVY sticker and ownerÕs name or risk removal from the property at ownerÕs cost.

3.      Trailer or stiffleg launched boats on their trailers shall be stored on the paved storage pads only as assigned by the Harbor Master and shall not infringe on the star boat storage area.

4.      The concrete pad west of the star stiffleg must be kept open at all times for trailer access to the stiffleg.

5.      The parking of unattended vehicles, trailers, or other equipment on the seawall sidewalk or in Òno parkingÓ areas is prohibited.

6.      Dock boxes must be purchased or rented through the Club, and are the only boxes allowed. For renters, there will be an annual charge for renting and maintaining the box at the rentersÕ slip. The renter is required to provide his own lock and to take reasonable care of the box. Members are not allowed to drill holes in the docks for securing dock boxes, or any other equipment. The Club shall install all boxes, both owned and rented.

7.      All existing dock boxes may stay until the member surrenders their slip. If the new slip renter wants a dock box, the new renter will be required to have an approved dock box provided by the Club, for the slip renter to rent or purchase. If the renter surrenders their slip and leaves his/her dock box until the beginning of the next season, the ownership of the left dock box transfers to the Club.

8.      No steps shall be allowed unless approved by the Harbor Master. It is important not to obstruct the walkway for safety reasons.

9.      All modifications to slips including, but not limited to, carpeting, lifts, and other similar items shall be approved by the Harbor Master and conform to these Harbor Rules and Regulations. These Rules and Regulations are to be on file with the Harbor Master, and published in the Ivy Log. No member shall make any slip addition not in conformance with the Rules and Regulations unless approved in writing by the Harbor Committee. Any addition not in conformance with the Rules and Regulations shall be subject to removal. Once the member has surrendered the slip any approved additions shall become the sole and exclusive property of the Club.

10.    No uprights may be installed without approval of the Harbor Master. Installation will be done by harbor personnel. Hooks should be installed in a safe manner on the upright for temporary line placement.

11.    No swimming, snorkeling or scuba diving in either Harbor, or at/near Harbor entrances, or along the east side of the south barges.

12.    Boat owners shall carry their own insurance coverage for loss, property damage and liability. The Club shall not be liable for any loss or damage occasioned by fire, theft, wind, floods, collisions or other acts not attributed to negligence.

13.    On docks, seawalls, or breakwaters, children under 10 must wear life preservers and be under the close supervision of their parents.

14.    Pets must be kept under control of the owner at all times. The owner is responsible for the cleanup activity required.

15.    Other rules from time to time may be issued and distributed to all boat owners. It is their responsibility to see that the rules are followed by their guests.

 

THE PURPOSE OF THESE RULES IS TO CLARIFY THE MEMBERÕS RESPONSIBILITY IN USING THE HARBOR AND TO PROVIDE A SAFE ENVIRONMENT FOR ALL MEMBERS AND THEIR GUESTS. FROM TIME TO TIME THE BOARD OF DIRECTORS WILL REVISE THESE RULES AND TO DO SO WE SOLICIT ALL MEMBERSÕ INPUT. PLEASE LET A MEMBER OF THE HARBOR COMMITTEE OR THE HARBOR-MASTER KNOW ABOUT ANY IDEAS THAT YOU MIGHT HAVE TO CHANGE, MODIFY, CLARIFY OR ELIMINATE A RULE THAT IS NOT NECESSARY. WE DO ASK THAT YOU PUT YOUR POSITION IN WRITING FOR CLARIFICATION PURPOSES.
